June 12, 1990 - Guardian. 5 Disabled 'ecstatic' as rights act clears House By DIANE COLEMAN The Americans with Disabilities Act, considered by many to be the most sweeping civil rights legislation since the 1964 Civil Rights Act, easily cleared the House of Representatives May 22. It is expected to reach the president‘s desk by July 4. The act prohibits discrimination based on disability in public accommodations, employment, transportation and telecommunications. It is intended to address "rampant, daily discrimination in every sphere of American life,“ Rep. Pat Schroeder, D-Colo., told her colleagues on the House floor. “Mentally retarded persons are kept out of restaurants. Persons with cerebral palsy are turned away from theaters. . . . Employers cite fears of hiring disabled persons because their customers will feel uncomfortable or even repulsed,” Schroeder added. Despite strong opposition from private business and transportation lobbies, chief among them the National Federation of Independent Businesses and Greyhound Lines, Inc. , the Americans With Disabilities Act achieved bipartisan support in both houses of Congress. The House vote was 403-29. Under pressure from the NFIB and the National Restaurant Association, the House version of the bill was amended at the last minute to allow employers to remove people with HIV infection from food handling positions. Sponsored by Rep. Jim Chapman, the amendment passed narrowly, although the Texas Democrat conceded there is no “evidence that‘AIDS can be transferred in the process of handling food.” Tom Sheridan of AIDS Action, representing 500 community-based service organizations, predicted that the Chapman amendment would go down to defeat in the House-Senate conference committee. “It’s a horrible amendment for all people with disabilities because . . . it begins to codify the fact that irrational fear is protected by the law,” he said. Nonetheless at press time Senate conferees had agreed to include the restrictions. “Cheers and tears” filled the House gallery at the moment of the ADA's long-awaited passage, according to Tennessee disabled activist Michael Gibson, “but we all know that the bill is only a first step. Several agencies will be writing key regulations which offer innumerable opportunities to weaken the effect of this legislation,” Gibson said. SOME DELAYS, FEW LOSSES While many activists feared the House would water down the Senate version of the bill, Marilyn Golden of the Disability Rights Education and Defense Fund said that the ADA “has not been weakened anywhere near the extent that much legislation is. " According to Golden, who has worked intensively for the bill's passage over the last two years, various timetables and phase-in provisions were adopted to avoid other forms of compromise. The ADA’s protections against employment discrimination, which parallel those applied to federally funded entities since 1973, do not go into effect for two years. Prohibitions against discrimination in public accommodations, such as theaters and restaurants, will require accessibility in facilities “construct[ed] . . . for first occupancy no later than 30 months after the date of enactment." Telephone companies will have three years to put in place a relay service for deaf people and others who depend on non-voice telecommunication. A requirement that all new public buses be lift-equipped will take effect in only 30 days. Many attribute this to seven years of non-violent civil disobedience by the American Disabled for Accessible Public Transit. Greyhound, a private carrier, was given six years to begin replacing its retired buses with accessible ones. Activists also waged a last-minute battle over employment discrimination remedies. Recently proposed legislation would add damages to the relief available to discrimination victims under Title VII of the Civil Rights Act of 1964. In the face of this, Golden said. the Bush administration tried “to renege on its agreement for parallelism” between the ADA and the 1964 act. It backed an amendment that would have kept remedies for disability-based discrimination at current levels if and when discrimination remedies are increased for other minority groups and women. The amendment was narrowly defeated just prior to the final vote on the bill itself. Overall, Golden said. “We're ecstatic." The ADA “will hopefully begin to convey to the American public. left, center and right (because in some ways I don't think the consciousness of the left is any better), that disability is not a personal issue, that there’s a systematic oppression of people with disabilities. . . . This is a short demo film by Linda Litowsky that tells about ADAPT and our first campaign for lifts on buses and passage of the Americans with Disabilities Act. It was made to promote a longer film she made so it ends abruptly. However it is a good overview of early ADAPT and has been used in many organizer trainings and presentations.

[This memo is continued in ADAPT 408, but the text of both is contained here for easier reading.] TYPED MEMO [title] SECURITY FOR APTA EASTERN CONVENTION St. Louis - May 14 Through 19, 1988 Set up Command Post at Omni Hotel. A line of communication will be set up between Command Post (Bi-State and the Police Departments of concern. The command rank of all Police Agencies of concern will be shown the APTA film on previous convention, which ADAPT members demonstrated. Line of communication set up with officials at the Arch. A direct line of communication will be implemented between all teams, 8i-State Security in the field and the command post. Also, a line of communication will be set up between officers in the field, the police departments, and between each team. The 8i-State Security will consist of officers from the Under-cover and Reduce Fare Programs. These officers will be working in both uniforms and plain clothes. We will also have police officers from the U.P.S.P. from the E. St. Louis Police Department and the St. Clair County Sheriff's Department. These officers (U.P.S.P.) will be organized into teams. The size of each team will depend on their assignment. Communication has been sent to the San Francisco, California, requesting copies of the film they have regarding the demonstration of ADAPT at a convention in their city. There will be made available a camera crew, with VCR-35 M.M. and polaroid cameras to capture any activity of the demonstrators. This film will be made available for use in court if needed in the event there are arrests. It will also be very useful for future use. All moves from the hotel by APTA conventioneers on convention planned activities will be monitored. The final destination of these trips will be kept under surveillance by uniform and plain clothes officers. All planned convention activities away from the hotel will be monitored to the extent that alternative routes will be planned beforehand. These alternate routes and access will have a code number or name. Security and Command Post will have a complete schedule on any and all planned moves. No moves will be made without Security or Command Post knowledge of same. Alternate means of access at the final destination will also be planned ahead. [page] 1 There will be advanced Security Teams sent ahead, and if they find the routes or final destination has ADAPT demonstrators gathering, this information will be sent immediately and directly to Command Post. It will be at this time the Command Post will give the Code as to what route and entrance to use. All team captains will have knowledge of these Code words or numbers, and to their proper use. All buses transporting APTA conventioneers will have a uniform or plain clothes officer on board at all times with a radio. The officer will keep in constant contact with Command Post. The Command Post will make the officers of board the bus or buses aware if they will be using the alternate routes and entrance to final destination and be given the alternative coded route and entrance to be used. Each officer on the bus(s) will acknowledge receiving the message. All movement of these buses will also be made available to the Police Departments of concern. Any demonstrators blocking the movement of any of our buses (Bi-State) or blocking the accessibility of entrance to our buses will be arrested and charged accordingly. Camera crew will be called if not already on the scene. Our 8i-State Security will play a major role in this activity. Bi-State will prosecute when we are involved in any arrest. Our security force will assist the police whenever possible. We will have a number of backup officers (reserve) on a standby status. They will be ready when or where ever needed. There will be roving field supervisors (U.P.S.P.) who will monitor all movements concerning the Eastern APTA Convention on the streets, and will keep the Command Post appraised of any and all unusual movements or gathering of the ADAPT demonstrators. The Command Post in turn will notify the Police Department of concern if so warranted. There should be made available two mini Call-a-ride vans. One will assist the law enforcement agencies to transport arrested demonstrators, and the other will be used by Command Post to deliver backup officers to locations they are needed, or for any other emergency which may arise. A sweep will be made each day of all meeting rooms, prior to their occupancy, by Bi-State security and hotel security for any hidden bugging devices or any type of explosives. Rocky Mountain News 12/15/1985 Disabled Protest RTD Buses By Joseph B. Verrengia Rocky Mountain News Staff Writer Denver police Thursday, arrested a handicapped protestor who ignored police warnings and rolled his wheelchair in front of a Regional Transportation District bus on East Colfax Avenue. Police said Mike Auberger, who belongs to a Denver-based, militant disabled-rights group known as ADAPT, was arrested at about 1:30 p.m. at the intersection of East Colfax Avenue and Cherry Street. Auberger, who also was arrested in Washington, D.C. last October for a similar disturbance at a national transit convention, was booked into the Denver County Jail for creating a traffic hazard. He was released at 6 p.m. on a personal-recognizance bond. A court appearance has not been scheduled. He was one of four disabled demonstrators who disrupted bus service at the East Colfax intersection for about one hour. They were protesting RTD’s delay in repairing broken wheelchair lifts on 303 buses. Squads of four wheelchair-bound protestors also blocked buses at the intersections of the 17th and California streets and Broadway and East Colfax Avenue. Wade Blank, an able-bodied demonstrators who organized the protests, said ADAPT will hold similar “hit-and-run rallies” at randomly selected bus stops throughout the six-county transit district until the RTD directors vote to fix the lifts. "RTD spent $250,000 moving Ed Colby’s furniture,” Blank said, referring to the amount RTD reimbursed new general manager Ed Colby for his 1984 moving expenses and related taxes, plus his regular salary. “But,” Blank said, “they won’t spend money to make these lift s work.” RTD has budgeted $753,059 to modify the lifts’ electrical systems, where transit officials estimate about 75 percent of the lift breakdowns occur. On Tuesday, the agency’s planning committee voted to delay the lift repairs until the directors reconsider the agency’s handicapped-passenger policy at a Feb. 26 board meeting. With lifts on about half of its 750 bus fleet, Denver has one of the nation’s most accessible public transit systems. However repairs to the unreliable lifts are so costly and disabled ridership so small – 12,000 rides a year – that some board members would prefer to transport handicapped passengers in specially-equipped vans. Blank and his protestors reject “dial-a-ride” and similar van service as separate–but-equal treatment. RTD spokeswoman Diana Yee said Thursday’s incidents caused brief “inconveniences” for passengers and forced several bus routes to run behind schedule. She said transit officials would call the police again if protestors continue to do lay bus service. “We cannot solve this issue on the street corner,” Yee said. Yee said RTD has scheduled two meetings next week in which handicapped protestors can challenge the agency’s decision to delay lift repairs. Gwinnett Daily News [Headline] Bush allows overnight protest [Subheading] Wheelchair-bound demonstrators demand equal access by Pat Murdock, Daily News Atlanta bureau Atlanta — A group of wheelchair-bound protesters were allowed to spend the night in the federal courthouse after President Bush came out in support of their demonstration over the government's failure to help the handicapped gain better access to buses and airports. Building security had been attempting to evict the estimated 150 demonstrators when a personal call from the president altered those plans around 8 p.m., said Gary Cason, a spokesman for the General Services Administration. “These people have an inherent right to demonstrate and a right to demonstrate in this building," he said. "They're free to stay here all night or as long as they wish." The demonstrators had staged a daylong protest at the downtown high-rise building and were being evicted by security when the president called. Members of the General Services Administration security force began evicting the protesters one-by-one when they refused to leave the Richard B. Russell federal building at the close of business. There were no reports of any arrests of the demonstrators, who staged a similar protest Sunday on the opening day of the American Public Transit Association Atlanta conference. During their eight-hour protest, the demonstrators blocked the street level entrances and exits to the building. Some wedged themselves in revolving doors while others shackled themselves to door handles. Members of the American Disabled for Accessible Public Transportation (ADAPT) said they staged the protest to coincide with the appearance of Secretary of Transportation Samuel Skinner at the convention. They demanded that Skinner sign an executive order requiring that buses, purchased with federal funds, be equipped with wheelchair lifts to aid the handicapped. Such equipment is not mandatory now. Skinner did not speak to the protesters. The protesters also called for the implementation of a 1986 federal law requiring equal access for the handicapped in airports. "We feel that disabled people are still on the plantation," Wade Blank, a co-founder of ADAPT, said. “They've never been freed." While visitors to the Russell building had to use fire stairs and alternate entrances, the protest only caused minor inconveniences, GSA spokesman Fleming James said. “We‘re concerned with the safety of the people in the building and the building itself." he said. “We had no problem with their right to protest." After the president's call, General Service Administration officials left the lights on in the lobby of the building for the protesters. Prior to the president's telephone call, officials felt less comfortable with moving dozens of wheelchair-bound protesters, some of whom locked hands and clenched the wheels of one another’s chairs. Some protesters dropped to the floor when security officers approached. One protester, who already had been evicted from the building, threw himself in front of a double door in an attempt to thwart the removal of others. “The police are caught in the middle and they try to be as humane as possible." ADAPT co-founder Mike Auberger said. Capitol Crawl
This video covers part of the Wheels of Justice rally and then the Capitol Crawl that took place on the west (Mall) side steps of the US Capitol March 12, 1990. This action, in which hundreds of people with disabilities took part, was done to push the Congress to move forward on the landmark civil rights bill, the Americans with Disabilities Act, ADA. The ADA had stalled in Congress and the disability community rose up to say enough is enough. It was part of a several day action by ADAPT to move Congress to act. It was also the culmination of a massive national grassroots effort by organizations and individuals from every state and territory in the nation to call for an end to discrimination based on disability. It symbolized the struggle people with disabilities faced in dealing with the society's discrimination, and the strength and perseverance of people with disabilities in facing these obstacles.

Tues., September 26, 1989 [Headline] Disabled Try to Block Access To Elevators [Subheading] Protesters Continue Russell Building Sit-In By Alma E. Hill and Pat Burson, Staff Writers [This is the full text of the story that appears on ADAPT 496, 509 and 488.] Protesters in wheelchairs moved to block elevators in the Richard B. Russell Federal Building today in their second straight day inside the building, as federal officials increased security. Ed Driver, chief of law enforcement for the General Services Administration, said six security guards were brought in “so that we can maintain access to and from the building." “We're not going to do anything, we just want to be able to maintain an element of safety in the building," Mr. Driver said. At 11:50 a.m., leaders of American Disabled for Accessible Public Transportation (ADAPT) gave the signal and protesters began to chant and roll their wheelchairs in front of the doors on the plaza level of the federal building to restrict access to and from the building, as they had done Monday. Moments later, in an apparent shift in tactics, the group moved toward elevators to cut off access to upper floors in the high-rise. Protesters said they will continue to demonstrate until President George Bush or Transportation Secretary Samuel Skinner complies with their demands to issue a federal mandate requiring new buses purchased with federal dollars to be equipped with wheelchair lifts. Judges who work in the federal building avoided problems getting out of the building by leaving before the noon takeover. And the doors to the Peachtree Federal Employees Credit Union, located in the southwest corner of the building, closed as soon as protesters began to shout. Visitors are being directed out of the basement and second floor exits. The Rev. However, the meeting never took place. “They got on the elevator and didn't tell us what floor they were going to. so we said, ‘The hell with it."' the Rev. Blank said. The protesters began their demonstration Monday to coincide with an appearance by Mr. Skinner at the American Public Transit Association (APTA) convention at a downtown hotel. After occupying the plaza floor of the federal building for eight hours Monday, more than 100 disabled activists were evicted at the close of the business day, only to be allowed back inside after President Bush personally intervened. “We're here until the order gets signed." Michael W. Auberger, of Denver, one of the co-founders and organizers of ADAPT, said Monday. Mr. Auberger and other demonstrators from throughout the country lined their wheelchairs two and three deep near the doorways to the federal building. located at the corner of Spring Street and Martin Luther King Jr. Drive, trying to stop anyone from leaving or entering. Mr. Auberger, who has been disabled since he suffered a spinal cord injury 17 years ago, and others blocked revolving doors by attaching chains and iron bicycle locks around their necks and locking them to door handles, a tactic used to prevent security from simply lifting protesters out of their wheelchairs to clear the doorways. At one point Monday afternoon Mr. Auberger, 35, said, “They'll have to carry everybody out or arrest them." At 6 p.m. Atlanta police and officers from the General Services Administration, who provide security for the building, ordered the protesters to leave and began carrying them outside. The guards used large bolt cutters to sever the chains holding some demonstrators to the doors. At about 8 p.m., as guards were removing the last of the demonstrators, Gary C. Cason, regional administrator of the General Services Administration, told police and maintenance workers to allow the protesters back into the building. “The decision is to let them stay in the building because of the president's deep commitment to the handicapped and their right to protest." Mr. Cason said. Mr. Cason said Mr. Bush also said he was concerned about the protesters sitting outside in the chilly overnight temperatures and rainy mist. Maintenance crews appeared a half-hour later with blankets. Mr. Cason said the protesters would be restricted to the lobby floor and would have access to the restrooms. Protest organizers credit White House counsel C. Boyden Gray for Mr. Bush's action. Mr. Auberger said they contacted Mr. Gray, who took their case to Mr. Bush. The president then called the head of the GSA, Richard G. Austin in Washington, telling him to allow the demonstrators back inside. The protest forced most visitors to the building Monday to use a basement entrance adjacent to an underground parking lot. Mr. Auberger said the group planned to stay in the building overnight and would block the entrances again at noon if the Transportation Department does not order changes in transit-access rules. “At noon the administration has to decide whether or not they are going to arrest us, or we’re closing the building down again,” he said shortly before 11 p.m., as the protesters ate Chinese food they had ordered and made themselves comfortable in the hallway on the Spring Street side of the building. The demonstration was the second in as many days held by ADAPT, a nationwide organization. The event was held in Atlanta to coincide with the annual conference of the American Public Transit Association (APTA), meeting this week in Atlanta, and to attract the attention of U.S. Transportation Secretary Samuel K. Skinner, who spoke to APTA Monday morning. APTA opposes legislation pending in Congress — that ADAPT supports — called the Americans With Disabilities Act. The proposal would remove barriers in public transportation by requiring public transit authorities to have wheelchair lifts on any new buses purchased 30 days after the measure was enacted. APTA officials say they oppose that portion of the measure because it would cut into limited federal funds. While Mr. Skinner has said he supports the bill, ADAPT wants him to issue an executive order so the stipulation can take effect immediately — prior to congressional action. Protesters demanded to talk with Mr. Skinner while he was in Atlanta, but Mr. Skinner departed for St. Croix without meeting with them. Robert Marx, a spokesman for Mr. Skinner, said the secretary does not have the authority to issue such an order, only the president. Spokesmen for ADAPT believe Mr. Skinner is not championing their cause because of a lawsuit the group won against the Chicago Transit Authority (CTA) two years ago, when Mr. Skinner was chairman of the city's Regional Transportation Authority. About 100 demonstrators called for more accessible public transportation. **************** Dozens of disabled people blocked access to the Richard B. Russell Federal Building today by parking their wheelchairs in front of revolving doorways to protest the lack of handicapped accessibility on public transportation. The protesters converged on the federal building to demand that Secretary of Transportation Samuel Skinner sign an executive order requiring any bus purchased with federal dollars to have wheelchair lifts. They also want the Air Carrier Accessibility Act of 1986 implemented. The act requires equal access in airports for disabled people. The protest coincided with Mr. Skinner's appearance in Atlanta as part of the American Public Transportation Association's (APTA) convention. The association has said local governments should be given the option of purchasing wheelchair lifts on buses, but the demonstrators want them mandated by federal law. “We're here and we aren’t going to leave until Sam Skinner signs the executive order," said\.Diane Coleman of Nashville. Ms. Coleman. who has been using a wheelchair since she was 11, said her disability is not the problem. “The problem . .. is discrimination,“ she said. “And behind that, the barrier is attitudes. We've been discriminated against for too long. and we‘re not going to sit for it any longer." The demonstrators forced scores of employees and people doing business at the federal building to exit from the basement. if they wanted to leave. All main level entrances to the building were blocked. After some people stepped over wheelchairs to get out, protesters lined their wheelchairs two and three deep to prevent people from walking over them. But some onlookers sympathized with the protesters. “I think these people have every right in the world to be concerned about their ability to gain access to public facilities. If it means I am temporarily inconvenienced, that's OK with me," said Edward Katze, a lawyer. The demonstrators vowed to hold their positions until Mr. Skinner comes to the federal building and suffered a spinal cord injury 17 years ago, and others blocked revolving doors by attaching chains and iron bicycle locks around their necks and locking them to door handles. a tactic used to prevent security from simply lilting protesters out of their wheelchairs to clear the doorways. At one point Monday afternoon, Mr. Auberger, 35, said, “They‘ll have to carry everybody out or arrest them." At 6 p.m., Atlanta police and officers from the General Services Administration, who provide security for the building, ordered the protesters to leave and began carrying them outside. The guards used large bolt cutters to sever the chains holding some demonstrators to the doors. At about 8 p.m., as guards were removing the last of the demonstrators, Gary C. Cason, regional administrator of the General Services Administration, told police and maintenance workers to allow the protesters back into the building. “The decision is to let them stay in the building because of the president's deep commitment to the handicapped and their right to protest," Mr. Cason said. Mr. Cason said Mr. Bush also said he was concerned about the protesters sitting outside in the chilly overnight temperatures and rainy mist. Maintenance crews appeared a half-hour later with blankets. and cots were promised. Mr. Cason said the protesters would be restricted to the lobby floor and would have access to the restrooms. Protest organizers credit White House counsel C. Boyden Gray for Mr. Bush's action. Mr. Auberger said they contacted Mr. Gray, who took their case to Mr. Bush. The president then called the head of the GSA, Richard G. Austin, in Washington, telling him to allow the demonstrators back inside. Mr. Auberger said the group planned to stay in the building overnight and would block the entrances again at noon if the Transportation Department does not order changes in transit-access rules. “At noon the administration has to decide whether or not they are going to arrest us, or we're closing the building do\vn again," he said shortly before 11 p.m., as the protesters ate Chinese food they had ordered and made themselves comfortable in the hallway on the Spring Street side of the building. The protest forced most visitors to the building Monday to use a basement entrance adjacent to an underground parking lot. The demonstration was the second in as many days held by ADAPT, a nationwide organization. The event was held in Atlanta to coincide with the annual conference of the American Public Transit Association (APTA), meeting this week in Atlanta, and to attract the attention of U.S. Transportation Secretary Samuel K. Skinner, who spoke to APTA Monday morning. APTA opposes legislation pending in Congress — that ADAPT supports — called the Americans With Disabilities Act. The proposal would remove barriers in public transportation by requiring public transit authorities to have wheelchair lifts on any new buses purchased 30 days after the measure was enacted. APTA officials say they oppose that portion of the measure because it would cut into limited federal funds. While Mr. Skinner has said he supports the bill, ADAPT wants him to issue an executive order so the stipulation can take effect immediately prior to congressional action. Protesters demanded to talk with Mr. Skinner while he was in Atlanta, but Mr. Skinner departed for St. Croix without meeting with them. Robert Marx. a spokesman for Mr. Skinner, said the secretary does not have the authority to issue such an order, only the president.
